APPEARANCE RELEASE

For good and valuable consideration, sufficiency and receipt of which are hereby acknowledged, I authorise Delia Dobrițoiu  and its parents, affiliates, subsidiaries, licensees, successors and assigns (“Company”) to make use of my appearance in the programme (the nature and content of which have been explained to me) tentatively entitled: the “PETS OF CHAMPIONS” and in connection with Company or otherwise.

  1. I hereby agree that Company may tape and photograph me, and record my voice, conversation and sounds (including any performance of any musical composition(s)), during and in connection with my appearance and I hereby irrevocably and unconditionally assign with full title guarantee to Company (such assignment to operate to the extent necessary as a present assignment of future copyright) all the copyright and other rights of whatsoever nature (including without limitation all performers’ property rights) throughout the world in all media whether now known or hereafter developed for the full period of copyright and all renewals, reversions, revivals and extensions thereof (and thereafter, insofar as may be or become possible, in perpetuity) in the results and proceeds of such taping, photography and recording for Company to hold the same absolutely. I hereby consent to the unlimited exploitation of the Programme and any part(s) thereof including any of my contribution in any form and by any media throughout the world.  I agree that the rights referred to above include without limitation those rights known as the lending and rental rights in and to any programme incorporating my contribution and I agree that no payment shall be due to me nor shall I make a claim for any payment against Company in respect of the exploitation of such rights. I further agree that Company shall be entitled to edit, copy, add to, take from, adapt or translate my contribution and I hereby irrevocably and unconditionally waive any so-called “moral rights” as I may have or hereafter acquire in relation to my contribution and the Programme.

  2. I hereby consent to the fullest use of my contribution without limitation and grant Company without my further consent the right to use and authorise others to use my name, voice, likeness, biography, photographs of me and recordings of my voice and my contribution in any way Company deems fit in connection with the exploitation, advertising and promotion of the Programme, broadcasters and/or distributors of the Programme.

  3. Company shall not be liable to me or my legal representatives for any loss or damage or injury to me or my property caused or suffered in connection with the making of the proposed Programme unless caused by Company’s negligence and recoverable on that ground.

  4. I warrant and represent that I am free to enter into and perform this agreement and that I have not misrepresented myself to Company. I warrant that my contribution shall not contain anything which is untrue or an infringement of copyright or any other rights of any third party or anything which is in breach of any obligation of confidentiality or which is calculated to bring Company into disrepute or which is defamatory.

  5. I agree that I shall not at any time either personally or by other means make any statement or disclose any information or photograph to any third party (including without limitation any media related organisations) relating to the Programme or Company’s general affairs in connection with the filming and/or the recording of my contribution hereunder.

  6. This agreement shall be freely assignable by Company. This agreement shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.

  7. I agree that all the pictures, footage, various materials and information about me and my pet can be used without any restriction in connection to the Pets of Champions project and in connection with the Company or otherwise.

  8. I hereby waive any right of inspection or approval of my appearance or the uses to which such appearance may be put.  I acknowledge that Company will rely on this permission potentially, at substantial cost and hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permissions granted hereunder.
